Supreme Court Blocks Cross Fines, Destruction

July 3, 2006

In a temporary victory for religious freedom in America, Supreme Court Justice Anthony M. Kennedy, acting for the Court, has issued a stay pending further legal action.

Last May, U.S. District Court Judge Gordon Thompson, Jr. ordered the city of San Diego to remove the cross from city property by Aug. 1 or be fined $5,000 a day.

However, the ruling by Justice Anthony M. Kennedy means that the cross will not have to be removed by Aug 1, and there will be no fine.

Since May, groups have come to pray at the cross, but behind the scenes San Diego officials and lawyers have been fighting Judge Thompson's ruling.  Their work became fruitful today as Justice Kennedy issued his ruling.

Judge Thompson said the cross violated the state constitution ban on any official endorsement of a religion, but in a referendum by San Diego voters, over 75% voted to keep it.

The court case will probably drag on many more months or years, and it is expected that the cross will be safe until all legal remedies are exhausted, possibly even a decision by the full Supreme Court.

Christians should rejoice in this answer to prayer, but they should also remain vigilant as the legal process continues.
